These Terms of Service govern your use of the New Brunswick Nurses Union (NBNU) website, member portal and digital services. By accessing our services, you agree to comply with these terms, applicable laws and professional nursing standards.

Membership obligations and professional standards

Professional conduct: As a healthcare professional and union member, you must maintain the standards established by the Nurses Association of New Brunswick (NANB) and The Association of New Brunswick Licensed Practical Nurses (ANBLPN), including the Code of Ethics for Registered Nurses, Nurse Practitioners, Licensed Practical Nurses and professional practice standards.

Confidentiality requirements: You must protect the confidentiality of patient information, member personal data and union business information accessed through our services. Unauthorized disclosure may result in disciplinary action from your employer and/or regulatory body.

Accurate information: You must provide accurate, current information for membership records and service requests. Misrepresentation of professional status violates both union rules and professional regulatory requirements.

Website and portal usage

Authorized access: Member portal access is restricted to current members in good standing. You must protect your login credentials and notify us immediately of unauthorized access.

Acceptable use: You may use our services for legitimate union business, professional development and member services. Prohibited uses include commercial activities, political campaigning unrelated to union business or sharing content that violates professional standards.

Content standards: All communications and content posted through our services must comply with professional nursing standards, avoid discrimination or harassment and respect confidentiality obligations.

System security: You must use reasonable security measures when accessing our systems.

Confidential information protection

Union business confidentiality: Information about collective bargaining strategies, grievance proceedings, membership lists and internal union deliberations is confidential and cannot be shared with unauthorized individuals.

Member information protection: Personal information about other members accessed through union services must be protected according to privacy laws and professional standards. Unauthorized use or disclosure is strictly prohibited.

Professional information safeguards: Health information, workplace incident reports and accommodation requests contain sensitive personal information subject to PHIPAA privacy protections and professional confidentiality requirements.

Intellectual property rights

Union content ownership: NBNU owns all website content, educational materials, forms, templates and digital resources unless otherwise indicated. These materials are provided for member use only and cannot be reproduced for commercial purposes.

Member content license: When you post content or submit materials through our services, you grant NBNU a license to use, modify and distribute the content for union purposes while maintaining your ownership rights.

Professional resources: Some educational materials and professional development resources are licensed from third parties and subject to specific usage restrictions outlined in accompanying documentation.

Disciplinary procedures and enforcement

Discipline: Violations of these terms may result in disciplinary action including warnings, service restrictions and/or membership suspension/revocation, following union due process procedures. Refer to NBNU’s Discipline Policy for details.

Liability limitations

Service limitations: While we strive to provide accurate information and reliable services, NBNU makes no warranties regarding the completeness, accuracy or availability of website content or member services.

Professional advice disclaimer: Information provided through our services is for general guidance only and does not constitute legal advice, professional practice guidance or specific workplace recommendations. Members should consult appropriate professionals for specific situations.

Third-party content: We are not responsible for the accuracy or appropriateness of third-party content, links or services accessed through our website.

Privacy and data protection

Privacy policy incorporation: Our Privacy Policy is incorporated into these terms and governs how we collect, use and protect your personal information.

Consent to data processing: By using our services, you consent to data processing necessary for union operations, member services and professional representation within the scope of our Privacy Policy.

Data breach notification: We will notify you of data breaches posing real risk of significant harm according to privacy law requirements and union communication procedures.

Dispute resolution

Internal resolution: Disputes regarding these terms should first be addressed through internal union procedures or direct communication with union representatives.

Mediation: If internal resolution is unsuccessful, disputes may be referred to mediation through a mutually agreed neutral third party.

Arbitration: Final binding resolution of disputes will occur through arbitration under Canadian Arbitration Association rules, with hearings conducted in New Brunswick.

Governing law: These terms are governed by New Brunswick law and federal Canadian legislation. Courts in New Brunswick have jurisdiction for injunctive relief and arbitration enforcement.

Service modifications and termination

Service changes: NBNU may modify services, website functionality or access procedures with reasonable notice to members through email communications and website announcements.

Membership termination: Membership termination for non-payment of dues, professional misconduct or violation of union rules results in immediate loss of service access according to union bylaws and due process procedures.

Voluntary resignation: Members may resign voluntarily with written notice, subject to obligations under collective agreements and professional regulatory requirements.

Service discontinuation: NBNU may discontinue specific services due to regulatory changes, financial constraints or strategic decisions.

Accessibility accommodations

Accommodation commitment: NBNU provides reasonable accommodations for members with disabilities to access services and participate in union activities.

Accommodation requests: Requests for accommodations should be submitted to our Communications team with appropriate documentation. We will engage in good faith discussions to provide effective accommodations.

Alternative formats: We provide information in alternative formats including large print, audio formats and accessible electronic formats upon request.

Barrier reporting: Members can report accessibility barriers through our feedback mechanisms, and we will work to address identified issues promptly.

Updates and amendments

We review and update these Terms of Service regularly to reflect legal changes, new services and union policy developments. Significant changes will be communicated through member notices with effective dates allowing reasonable implementation time.
